'Equity theft' ruled unconstitutional by Massachusetts court
A ruling by a superior court judge is one more blow to a century-old practice in Massachusetts of municipalities taking the total value of a property even when only a small fraction of that amount is owed in taxes.
The ruling comes in the wake of a unanimous US Supreme Court decision last year that said municipal and county governments may only recover the taxes owed, and not seize the remaining equity in the property.
